1. This Agreement

1.1. About this Agreement: This agreement sets out the terms  and conditions of your use of giftcardconverter.co.uk whether this is to buy or sell gift cards/gift voucher or simply to browse the site and your actions post the agreement to buy or sell between you, other users and Giftcard Converter  ("giftcardconverter.co.uk”, “GCC”, "we", "us" or "our"), registered at Giftcard Converter Limited, 24 Nicholas Street, Chester CH1 2AU. Company Number 7117062. The use of GCC includes any service provided by us, including the use of our website ("the Site"), buying and/or selling giftcards and/or vouchers or other items on our Site. “Giftcard” incorporates the use of “gift cards” and/or “gift vouchers”. By using GCC in any way, you agree to abide by and be bound by this Agreement. We strongly recommend that you read and understand this Agreement.

1.2. Buyers and Sellers: In this agreement and on the site, a Buyer is classified as someone who is looking to buy or purchases  giftcard(s) on GCC, a Seller is classified as someone who registers and uploads their giftcard details with the purpose of selling it to a buyer on GCC.   

1.3 Site Access:  This website will be governed by the laws of the UK therefore only available to customers living within the UK.  

1.4 Giftcards: The GCC service exists for the sole purpose of allowing customers to buy or sell their giftcards with other users on GCC. It is the customer’s responsibility to adhere to the terms and conditions of the giftcard, as we accept no liability for the retailers’ terms and conditions. 

1.5 Giftcard Values: GCC is only available for giftcards from £10 in value up to a maximum of £600  in value and only available from the listed retailers. Customers wishing to sell/trade giftcards that are not listed or above the £600 limit should contact GCC to establish if their giftcard can be listed.

 1.6. Amendments: We may need to update this Agreement. If we update this agreement we will post the new version of this Agreement on our Site. Although you may have read and agreed to a previous set of conditions, you will be subject to the terms of the Agreement that are in force at the time you use this Site whether this is to browse the site, or buy/sell/trade gift cards. Your continued use of GCC means that you accept any new Agreement that is posted at the time of your transaction. 

2. The Concept 

2.1. People who register on the site sign up to become users of GCC ("Users"). Users can list giftcards for sale.  When Sellers list a giftcard on the site, we will require them to register their details to create an account. The buyer is purchasing a card on the site from sellers. GCC simply exists to facilitate people to buy/sell/trade giftcards so unfortunately we cannot guarantee that in every case a user or Buyer complete any transaction.

 3. All about Users 

3.1. Requirements: In order to use GCC, you must have agreed to this Agreement and you must be able to enter into legally binding contracts. If you are under 18 you may only use GCC with the involvement of a parent or guardian. 

3.2. Registration: In order to use the giftcard service (to buy, sell giftcards) we require you to register on the site. As you would expect, you must give us your correct details when you register, including the right name, address and other contact information. If these change it is your responsibility to let us know as soon as possible. 

3.3. Login Details: You can choose your own username (we recommend you use your e-mail address) and a password will be allocated to you when you login but again we would recommend that you change the password. We recommend that you develop a highly secure password that includes numbers and a digit. It’s important that you keep both secure and don't give them out to anyone else, especially as you are responsible for any activity undertaken using your username and password. Your username and password are personal to you and may not be transferred to anyone else. Due to the nature of the website, you must also agree that you won’t allow anyone access to your username and password to use GCC. 

3.4 VAT on the sale of giftcards: The trader or seller is responsible for paying any Value Added Tax ('VAT) to HM Revenue and Customs if applicable. GCC take no responsibility for this.

4. Selling Giftcards 

4.1. Listing: As a Seller, the first step to selling your giftcard on GCC is to list your giftcard on GCC. We require that you provide accurate information about the giftcard you are wishing to sell  including the name of the retailer, the face value of the giftcard, the amount your wish to sell the giftcard for, the expiry date, the serial number and the pin access number. All this information will be asked when you add a card into your wallet when you become a user.

4.2. License: To allow us to use your giftcard of the site so that others can view the details, you give us the right to display the giftcard you own on our Site.  

4.3. Pricing: You can list your giftcards for sale with us at any fixed price you choose. We recommend that you try and sell your giftcard for 90% of its value. 

4.4. Seller's Fee: Listing giftcards through GCC is free and GCC does not charge a fee for selling the gift card through our website

 4.5. Supplying the giftcard: If you list your giftcard and then agree to sell it to a buyer, you are entering into an agreement to sell that giftcard. That agreement is binding and you are required to send the giftcard (which means all the details provided about the giftcard are accurate) to that buyer.  

4.6. Acceptance of Your Offer to Sell: A Buyer accepting to buy your giftcards has an enforceable contract to buy that exact giftcard. You are then required to send the giftcard within 5 working dates of the agreed sale date.. 

4.7. Sending Buyer Details: When you begin the shipping process, you will be provided with the name and address of the Buyer. You agree to send the giftcard within 5 working days after the sale confirmation date (via Royal Mail either through registered, or recorded signed for, or via another courier company).  You also agree to cover the costs of shipping. It is important that you keep a record of the shipping details for 30 days.  You assume liability for the successful delivery of the giftcard. If there is a dispute with the delivery of the giftcard, you must produce evidence to paypal of the shipping. 

 4.8. Payment:.  You will be paid directly via paypal and it is your responsibility for ensuring that if you no longer wish to sell your giftcard to contact paypal to cancel the order.

 5. Buying Gift Cards 

5.1. Choosing a giftcard: As a Buyer, you choose a giftcard from our listings, register with GCC and click to buy that giftcard, accept out terms and conditions. You will then be transferred to paypal  to pay  If you're using a credit or debit card, that card must not expire within 30 days of the date of purchase.  

5.2. Pricing: We will set out for you the value of the gift card, and the price you have bought the giftcard for.  

5.3. Delivery: The Seller will send you the giftcard within 5 working days of the sale agreement date.  If the giftcard has not been received by the seller within 7 working days, you need to inform paypal and raise a dispute.   

7. Your Commitments to Us

7.1. About You: You confirm that the information you have submitted to us in your registration to become a User and in all other transactions and communications with GCC and other Users is true, accurate and complete.

7.2. Ownership: You confirm that you own the giftcard, and that you are entitled to list them for sale/trade.

7.3 Selling Stolen or Counterfeit Giftcards: Selling stolen or counterfeit property is a crime . GCC will report any such activity to the relevant authorities and permanently ban anyone found selling stolen or counterfeit giftcards from using GCC.

7.4 Transferring ownership: when a Buyer accepts your offer to sell a giftcard listed through GCC, you are required to provide that giftcard to the Buyer. Once you do this you are agreeing to transfer ownership of the card to the Buyer/Trader. Once a purchase is agreed, you agree to not list your cards on any other website or spend the giftcard to lower its value. If you list giftcards for sale that you don't then supply to a Buyer or the giftcard is not of the value advertised, we may charge you upto the full amount of the card value and may include any costs incurred by GCC (usually a £10 admin fee). We will also remove you from the as a user of the site immediately.

7.5. Accuracy and Completeness: Whenever you list a giftcard with GCC as Seller, you confirm that all information you give to us about the giftcard is correct and accurate.

7.6. Other Information: During any transaction or communication with GCC or any user you confirm that any information or content you provide to us or any user (a) is not fraudulent; b) is true, accurate and not  misleading; c) does not involve countererfeit or stolen items; d) does not infringe any third party's rights e) does not infringe any law, regulation or code  and does not breach any applicable GCC policies or guidelines; and f) does not contain any virus or other programme that interferes with or seeks to interfere with any computer system or data.

7.7. Legal Compliance: You confirm that, during any interaction with GCC or any User, you will comply with all applicable UK laws governing the use of the GCC website. You confirm that you are 18 or over and are  able to enter into legally binding contracts.

7.8. Indemnity: You agree to hold us harmless against all losses, liabilities, claims or demands arising out of any breaches of the representation and warranties and assurances in this clause 7.

8. The Consequences

8.1. Suspension and Investigations: If we discover any user not doing what they have agreed to do we may cancel or suspend their account whilst we investigate. If you are under investigation by GCC, you agree to comply fully with our or paypals requests for information about the giftcards and circumstances surrounding any transactions involving the GCC Services.

8.2. GCC Actions: GCC can take action in relation to your account or any sales or trades that you may have that are still pending. This includes issuing warnings, or terminating your use of GCC if we think you have behaved in the following way: a)  you breach this Agreement in any way; b) you fail to cooperate with any investigation we instigate as set out above; c) we cannot fully verify any information you provide, or it conflicts with other information that we hold; or d) if in our sole opinion your activity is likely to lead to legal liability for any User or us. We can remove any listings or cancel any sales if we believe  that the activity connected with that listing or sale is either illegal or in breach of this Agreement.

8.3. Disclosing Information: We reserve the right to inform any relevant authorities of any illegal activity conducted by any user using GCC and will cooperate fully in the prosecution of any such user.

8.4. Fraud: If we think you are involved in any fraudulent activity on a particular transaction GCC will reserve the right to put that transaction on hold whilst we investigate. We also reserve the right to cancel the transaction. If necessary GCC will contact the authorities with details of any suspected wrongdoing.

9. Customer Comments

9.1. Contributions: If you provide comments or feedback to GCC  we reserve the right to post these comments onto the GCC website  and we have the right to use your first name and town of residence (but will not disclose any of your personal data).

10. Liability

10.1. We do not accept liability for any losses you suffer for uploading your gift card to the site that are subsequently sold.

10.2 Disclaimer: We do not guarantee that the GCC website and services we offer will be totally free of errors. We do not guarantee that the service will be uninterrupted.  GCC does not take any liability for the acts and omissions of any third party user.

11. Ownership of Intellectual Property

11.1. The content and functionality on this site are the property of GCC. You may visit the site and  take screengrabs of the site for your personal non commercial use. You may not without our permission reproduce, edit, publish or transmit this site. You may use the site to buy/sell or trade giftcards for personal use only.

11.2. You may not deep link into the site without GCC’s permission.

11.3. The Giftcard converter name and logos can only be used with GCC’s permission.

12. Personal data

When you register your details with GCC, we will ask permission from you to use your data for marketing purposes.

13. General

13.1. GCC will not be held responsible for any delay or failure to comply with our obligations under this Agreement if the delay or failure is due to  a cause beyond our reasonable control.

12.2. If this Agreement is breached by you  and GCC do not take any action against you, GCC shall still be entitled to use our rights and remedies at a later stage or in any other situation where you breach this Agreement.

13.3. All issues or notices regarding this Agreement should be sent to : customersupport@giftcardconverter.co.uk.

14.5. If any part of this agreement becomes unenforceable, it doesn’t stop the remaining elements of this agreement still being legal and therefore binding.

14.6. This Agreement is governed by  the laws of England and Wales. You agree, as we do, to submit to the  jurisdiction of the English Courts.
